How a Refederation Party government in Victoria will LAWFULLY change the way Ottawa forces British Columbians to pay income tax

[Read statement of Premiers that income tax is payable only to the Provinces]

With a BC Refed government in Victoria, the control over all personal income tax collected from British Columbians will revert to the province in a gradual series of timed steps, as follows.

• 1. First, the Memorandum of Agreement between the central government and the government of the Province of British Columbia on the collection of taxes (known as the federal/provincial tax collection agreement) will be terminated by the province.

• 2. Next, the procedure contained in that former tax collection agreement will be reversed. That is, the province will collect all personal income tax paid by British Columbians, and will remit the federal portion of the tax to Ottawa.

• 3. Subsequently, deductions from the federal tax owed by BC to Ottawa will be negotiated, based on the actual cost of federal services provided to the Province.
• 4. Next, after a period to allow for adjustment, the province will declare that all direct taxation is exclusively a provincial jurisdiction. All income tax will then be paid to the BC Treasury only, for use in BC.

• 5. At a later date, the province will negotiate the provincial collection of the GST charged in BC, which is also a direct tax.

• 6. Throughout the negotiations the provincial government positions will be supported by a majority of BC voters. The will of the BC electorate in these negotiations will be declared in accordance with the BC Direct Democracy Act. The BC Democracy Act will draw its legitimacy from the Constitution of British Columbia. The Constitution of British Columbia will decree the “Supremacy of the People over the Legislature”. This doctrine of the supremacy of the people over the politicians will be approved by the people. That is democracy.

• 7. Throughout the negotiations the legitimacy of the central government and its institutions (eg the Supreme Court of Canada) will be called into question. The authority of a de facto (unlawful) central government to force its demands on a de jure (lawful) provincial government will be doubtful, at best.

• 8. A de jure (lawful) BC Refed government in Victoria will recognize the lawful authority of any Canadian central government which has been formed in accordance with a constitutional document that has been approved by a m
ajority of the Canadian people. That constitutional document must contain a watertight direct democracy mechanism.
